Seal of the United States Court of Appeals for the Ninth Circuit. U.S. Government Public Domain

Update: Plot twist

The White House won’t immediately appeal this ruling.

Josh Blackman has an interesting post explaining the possible paths going forward for the Trump administration.

The temporary restraining order against President Trump’s executive order is still in effect, as you probably know. Josh Blackman has a good analysis of the ruling on his website, which I would recommend reading. There are a number of fascinating and disturbing elements of this decision, including the imposition of a “no evidence” standard upon the Trump administration. Although some are attempting to put the best face on what is a sweeping, unprecedented ruling, the truth is that we are entering uncharted waters. We have the largest circuit court in the federal system essentially erasing the plenary power doctrine as it relates to immigration matters.

The fact that the administration was intentionally hamstrung in its appeal is irrelevant in the larger context, i.e. we are dealing with a federal judiciary that’s unwilling to recognize Congressional and presidential authority to execute immigration law. What’s more, the reasoning, such as it is, behind this decision is so shoddy that it would be laughable if the consequences weren’t so dire. The idea that universities and colleges have a vested interest, i.e. continuing the flow of tuition dollars from the coffers of foreign students, which supersedes the national security concerns of the President and his cabinet would be an absurdity in any other era. Keep in mind, Khalid Sheikh Mohammed, the defiant architect of the 9/11 massacres, was brought to the United States along with other Muslim students from abroad in order to pad the enrollment and keep afloat a struggling North Carolina college.

Even if the statutory and Constitutional rationales for enjoining the President’s executive order are incredibly weak-which they are-that doesn’t make the path forward any easier. Whether the administration decides to rewrite this EO from scratch, as some have suggested, or simply appeals to the Supreme Court, those of us who believe that American interests outweigh those of foreign nationals and international organizations have already been dealt a grievous blow by a judiciary which no longer recognizes itself as a co-equal branch of government.

How long before this quasi-ironic tweet becomes a reality? I suppose we’ll find out soon enough.

Passing Through http://american-rattlesnake.org/2017/01/passing-through/ http://american-rattlesnake.org/2017/01/passing-through/#respond Sun, 29 Jan 2017 17:22:21 +0000 http://american-rattlesnake.org/?p=24200 Aerial image of John F. Kennedy International Airport in Queens, New York, United States. April 8, 1994 Author: United States Geological Survey

As most of you probably know, a federal judge has blocked portions of President Trump’s executive order pertaining to refugees from 7 Muslim majority nations. Josh Blackman has published a good summary of what this injunction accomplishes, as well as a copy of the temporary restraining order itself. According to reports, it applies to a few hundred foreigners who were either on American soil or on their way to the United States before the EO was issued. Although these individuals have temporary avoided the fate of the character portrayed by Tom Hanks in The Terminal, it’s worth noting that there are much bigger issues at stake in this debate.

The open borders know nothings have deftly exploited the ignorance of large swathes of the American public to score a public relations victory against a man whom they’ve impotently warred against for over a year. Ironically, one of the refugees Democratic partisans claimed to be rescuing was able to succinctly explain why our new President’s immigration policies were in fact pretty reasonable. Beyond the simple observation that this executive order is not a ban on Muslim refugees, we have to confront the truly bizarre notion that our current refugee resettlement policy is somehow beneficial to American citizens. While some armchair analysts on social media have made the assertion that this is not the point of refugee resettlement-a point on which we agree-others have claimed that not importing tens of thousands of Muslim refugees from abroad poses a risk of future terrorism. By this token, Japan-which has a de facto ban on Muslim immigration-should be as unlivable as Afghanistan or Pakistan. Or, at the very least, have as many terrorist attacks as Turkey.

It’s a patently absurd suggestion, yet one which is repeated without shame by open borders apologists who have no rational justification for our country’s bizarre refugee resettlement program. Just as the beliefs of Angela Merkel and Francois Hollande-two European leaders who have presided over an unprecedented spree of Muslim terror within their countries-is a laughable excuse to invite in potential security risks, so to is the misguided notion that we’re creating terrorists by not letting potential terrorists onto American soil. Nearly half of the refugees admitted to the United States, and over 30% of those admitted since the 9/11 attacks, are Muslim. To comprehend why this is such a problem you need only scroll through a week’s worth of posts on Refugee Resettlement Watch.

Leaving aside the potential for terrorism-both domestically and abroad-exploitation of the welfare system, and crime, there’s the fundamental incompatibility of cultures. As the economist Nassim Taleb has pointed out, Americans expect foreigners who come here to accept American values and customs-and at a bare minimum, not to impose their values upon us. Whether or not this is a realistic expectation is another matter, but the idea that every person coming here does so because they want to become part of American society-a notion regurgitated endlessly by open borders advocates-is simply preposterous.

Even those who don’t pose a direct threat to the health and safety of American citizens-who don’t engage in honor killings, as dozens of Muslims families in the United States do each year-hold beliefs that are fundamentally at odds with those which shaped this nation. While those views are normal in Iraq, Somalia, or Syria, they are not in the United States, and we should not attempt to normalize them-to borrow a phrase from the unhinged left. President Trump’s order, however crudely executed, was the right thing to do. Hopefully, it’s just the beginning of a completely new approach to this vital issue.

The official news wire of ISIS has taken credit for today’s jihadist attack.

The perpetrator allegedly recited Islamic prayers during the attack.

The Daily Beast has published an exclusive on  Omar Mateen, the son of Afghan immigrants-previously investigated by the FBI-who was responsible for the Orlando massacre earlier today. Read it in full.

Father Mir Mateen told NBC News that the sight of two men kissing angered his son.

“We are saying we are apologizing for the whole incident,” the father added. “We weren’t aware of any action he is taking. We are in shock like the whole country.”

The attack, he said, “has nothing to do with religion.”

A Twitter user raises an interesting point about how gay-friendly Orlando truly is, at least within its Islamic precincts.

South of the Border http://american-rattlesnake.org/2015/06/south-of-the-border/ http://american-rattlesnake.org/2015/06/south-of-the-border/#respond Sun, 21 Jun 2015 04:43:59 +0000 http://american-rattlesnake.org/?p=19101 http://en.wikipedia.org/wiki/File:Usumacinta.jpg

To the surprise of very few, the Associated Press reports that over an 8 month period Mexico deported more Central Americans than the United States. Take particular note of this passage:

In most cases, Mexico holds migrants only long enough to verify their nationalities, and quickly bundles them aboard buses to take them back to their home countries.”

That is not the case in the United States, where most who claim “credible fear” can remain pending an asylum court case, as long as the Border Patrol can’t prove the person has a criminal record.

Combined with the Obama administration’s complete abandonment of worksite enforcement, the imminent resettlement of thousands of Syrian Muslim refugees, and its omnipresent threat to completely disregard the law, this latest revelation makes it perfectly clear that this White House holds American citizens in contempt and does not care about their thoughts in the slightest.

Is it any wonder that, in addition to having a Congress which is universally loathed, we have a President of staggering unpopularity? Where is Tom Tancredo when we need him?

The Mosque That Hate Built http://american-rattlesnake.org/2015/06/the-mosque-that-hate-built/ http://american-rattlesnake.org/2015/06/the-mosque-that-hate-built/#respond Thu, 04 Jun 2015 04:00:54 +0000 http://american-rattlesnake.org/?p=18996 640px-Islamic_Society_of_Boston

This week’s thwarting of a plot to behead Pamela Geller by a jihadist cell in Massachusetts might have surprised those of you who aren’t familiar with the deep roots that Islamists have sunk into the Bay State. Even though the Boston Marathon bombing by the Tsarnaev brothers has shed some light on this disturbing phenomenon, leading some to investigate links the Islamic Society of Boston has to Islamic terrorists operating both domestically and overseas, there is still a lack of awareness among the general public about this threat.

That’s why the work of patriotic, anti-Islamic extremist organizations like Americans for Peace and Tolerance is so vital at this moment. Created by anti-slavery, pro-Israel activist Dr. Charles Jacobs, APT has spent many years educating the public about the dangers posed by extremist clerics preaching envenomed sermons at local mosques in Boston and surrounding suburbs, even if it has meant bucking entrenched political and religious interests in order to alert citizens to the threats within their midst.

While the deceased jihadist might have been supported by Islamic State actors outside of the United States, we need to discover who and what prompted him to begin this journey, and whether or not the focus of this investigation should include the mosque whose alumni read like a Who’s Who of ambitious jihadis.

Members of NY ICE at the DC March for Jobs

The breadth of support enjoyed by BALA in its March for Jobs and equitable treatment of American workers can be seen in the lengths to which so many patriotic citizens traveled in order to attend this rally. From South Central  Los Angeles to the tip of New England, angry Americans of divergent ideologies and different races joined hands in order to stand up for the besieged workers of this nation.

One group represented was the indefatigable New Yorkers for Immigration Control and Enforcement, whose members can be seen marching towards Freedom Plaza in the photo above. Joanna Marzullo, President of NY ICE, gives her impression of the rally below the fold.

July 15, 2013, Washington, DC.  NY ICE Members joined national groups and individuals opposed to amnesty for those illegally in the U.S. at the DC March for Jobs.  This video is from the event.  The video is 2 minutes long and very inspiring and worthwhile.

Particularly noteworthy in the video is Steve King’s statement, when referring to the extreme heat on that day, that “I think it’s altogether fitting and proper that we should sweat here today as we stand up for the American worker”.

The emphasis of this march was on the detriment of the illegal alien stampede to the American worker, and it was organized by black Americans. Black Americans were there to say that illegals undercut the wages of jobs that have often employed the black American worker, stealing jobs from the black American worker and their families.

But illegals only want to frame their story in terms of their families, and never mention the harm the net drain of their illegal alien presence does the black American (or any other American!) family.  They never concede that the U.S. is supposed to be a sovereign country.

NY ICE has long maintained that there are no jobs that Americans won’t do, only wages that Americans will not work for.  When illegal aliens trespass into the U.S. and illegally obtain jobs (let us not forget that it is illegal for an illegal alien trespasser to even have a job, as well as it is illegal for the employer to hire them), they undercut the wages for those jobs.  Illegals are often working in the cash economy, so employers can often pay them whatever they want, and this, of course, is unreported and untaxed income.

This is an amenable situation for the illegal alien because they are often sending the money back to their home countries, where the American dollar goes further, and many plan to “live like kings” upon their return.

Illegal alien trespassers have no sympathy for the American and legal immigrant families that they are undercutting and the U.S. resources that they are draining.

Americans owe illegal aliens nothing.

Stop The Gang Of Eight http://american-rattlesnake.org/2013/05/stop-the-gang-of-eight/ http://american-rattlesnake.org/2013/05/stop-the-gang-of-eight/#respond Tue, 28 May 2013 20:29:48 +0000 http://american-rattlesnake.org/?p=15188 Notwithstanding the musings of Senator Robert Menendez-a man whose employment of an illegal alien sex offender illustrates the perils of leaving immigration to the discretion of this administration-the amnesty crafted by the Gang of Eight remains on course for passage by a majority of the U.S. Senate. Continued impoverishment and unemployment for Americans is just one of consequences of this bill, should it be enacted into law. Thankfully, there are many conservatives-who speak not only for themselves or the profit motive of their benefactors, but the majority sentiment of Americans-who have taken a courageous stance against this preventable disaster.

The antidote to Chuck Schumer Republicanism can be found in a coalition of conservative activists opposing this bill that have created a site to voice their views, Stop The Gang Of Eight. You can add your name to the voices of opposition by signing their petition decrying S. 744. Let’s turn that voice in the wilderness into a raging clamor to defend the rights and interests of Americans.

Remember 1986: National Press Event http://american-rattlesnake.org/2013/05/remember-1986-national-press-event/ http://american-rattlesnake.org/2013/05/remember-1986-national-press-event/#respond Sun, 19 May 2013 04:36:18 +0000 http://american-rattlesnake.org/?p=15052

Remember 1986-an exceptional organization created to prevent history from repeating itself-is holding a nationwide press event this coming Tuesday! The public event in Arizona-the state whose courageous example inspired the creation of American Rattlesnake-is merely one of many being held around the country  to echo the sentiments of millions of Americans who refuse to accept the imposition of another legislative amnesty by an unaccountable Congress and White House.

603604_10151604335117158_775804920_n

Florida will be holding a funeral for the American worker, a species that is nearing extinction because of the avarice and solipsism of our elected officials; Americans will find it even more difficult to find  gainful employment once the Gang of Eight’s scheme is enacted into law. Despite the purposefully anodyne name, this is a potentially ruinous piece of legislation which will not only naturalize-as well as enfranchise-between 15 and 20 million illegal aliens, but also allow tens of millions more legal immigrants into the United States in the coming decades, despite overwhelming opposition to this policy by the American public.

There will be events held in the Tri-State Area in concert with Remember 1986, including press conferences by New Jersey Citizens for Immigration Control and New Yorkers for Immigration Control and Enforcement. We’ll provide the details of NY ICE’s press conference in tomorrow’s post, but I urge you all to participate in this national press event if your involvement is at all feasible. Join NY ICE, NJCIC, Jamiel Shaw Sr. and his family, as well as scores of other patriotic citizens, and stand up in defense of this nation’s territorial integrity and the rule of law!
You won’t get another opportunity.
